General Terms and Conditions of CO2.EU Limited
1. Definitions
- CO2.EU BV: CO2.EU BV, a private limited liability company located at Maasstraat 9, 2991 AD in Barendrecht, Netherlands, registered with the Chamber of Commerce under number 88191531.
- Customer: the natural person or legal entity entering into an agreement with CO2.EU BV.
- Agreement: the agreement between CO2.EU BV and the Customer, including these general terms and conditions.
- Products: the products supplied by CO2.EU BV to the Customer, including CO2 certificates, solar panels, and energy storage batteries.
2. Applicability
These general terms and conditions apply to all quotations, offers, agreements, and deliveries of CO2.EU BV. The applicability of any customer's general terms and conditions is explicitly excluded.
3. Agreement
An agreement is concluded by the acceptance and payment of an offer on one of our websites, CO2.eu, CO2.NL, or CO2.FR, by the customer. The agreement is made under the suspensive condition of sufficient availability of the products.
4. Prices
The prices of the products on the website(s) include VAT. CO2.EU BV reserves the right to change prices. The modified prices apply to orders placed after the change.
5. Delivery
CO2.EU BV delivers the CO2 certificates to the customer's specified email address. Delivery of solar panels and energy storage batteries takes place within 30 days of the agreement, unless otherwise agreed with the customer.
6. Payment
The customer must pay CO2.EU BV online when making a purchase through CO2.EU, CO2.NL, or CO2.FR.
7. Retention of Ownership
The products remain the property of CO2.EU BV until the customer has paid the full purchase price.
8. Warranty
CO2.EU BV guarantees that the products comply with the agreement. The warranty period is 10 years, applicable to energy storage batteries and Solarpads
9. Liability CO2.EU BV is not liable for damage caused by:
- Defects in the products that do not conform to the agreement;
- Use of the products contrary to the instructions;
- Customer's instructions;
- Force majeure. CO2.EU BV's liability is limited to direct damage. Liability for indirect damage, including consequential damage, is excluded.
10. Complaints
Complaints about the products must be submitted in writing to CO2.EU BV within 14 days of receiving the products. CO2.EU BV will respond within 30 days of receiving the complaint.
11. Disputes
All disputes between CO2.EU BV and the Customer are exclusively settled by the competent court in the Netherlands.
12. Final Provisions
These general terms and conditions are binding in all respects for CO2.EU BV and the Customer. The Customer cannot derive any rights from these general terms and conditions that are not expressly included.
Additional Provisions
- CO2.EU BV has the right to amend these general terms and conditions. The amended terms apply to all orders placed after the amendment.
- CO2.EU BV has the right to terminate the agreement if the Customer fails to meet its obligations under the agreement.
- CO2.EU BV has the right to terminate the agreement if the Customer is declared bankrupt, applies for a suspension of payments, or ceases its business activities.
